Please read this carefully. These are the terms and conditions on which you may use the howtospendit.com website and the content/services available on it (which we call "HTSI Content"). These terms apply to your use of howtospendit.com and all HTSI Content irrespective of the delivery platform or device you use to access it. By accessing howtospendit.com you are agreeing to the terms and conditions below. If you use howtospendit.com in the course of your business or work, you are also agreeing to these terms and conditions on behalf of that business.

1. Introduction

These terms and conditions were first published on 3 October 2009. To the extent permitted by law, FT may change these terms and conditions and will provide notice of such changes in Section 9 below. You should regularly check Section 9 of these terms and conditions to see if any changes have been made. By using howtospendit.com after we have posted any changes, you are agreeing to be bound by them. If you do not agree to the changes you should cease using howtospendit.com. References in these terms and conditions to "FT" (or "we", "us" or "our") refer to The Financial Times Limited, see Section 8 below for more details.

2. Access and Use

Certain content and features of howtospendit.com are accessible to all users and other content and features are only accessible to registered users. FT may change, alter, suspend or withdraw any part of howtospendit.com or the services available on it at any time.

Permitted Use: All HTSI Content belongs to FT or its licensors. FT or its licensors own all intellectual property rights (including copyright and database rights) in the HTSI Content and any selection or arrangement of the HTSI Content. You may for your personal, non-commercial use:

Restrictions on Use: You may not use howtospendit.com for any unlawful purpose. Except as expressly set out above, you may not copy, reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive, publicly display or in any way commercially exploit any of the HTSI Content. Without limitation, you may not do any of the following without prior written permission from FT (and neither may you allow a third party to do any of the same):

You acknowledge that "How To Spend It", "FT" and "Financial Times" are registered trade marks and that you may not use them without written permission from FT.

Linking: If you would like to link to HTSI.com, please read and comply with the following guidelines and all applicable laws. A site or service that links to howtospendit.com:

FT expressly reserves the right to require that any link in breach of these terms and conditions be removed and to take whatever other action it deems appropriate.

PLEASE NOTE THAT IN ADDITION TO OUR RIGHTS AT LAW TO RESTRICT THE TYPES OF USE REFERRED TO ABOVE, THESE RESTRICTIONS ARE ALSO CONTRACTUAL IN NATURE AND BIND ALL USERS OF HOWTOSPENDIT.COM.

If you are using howtospendit.com other than for non-commercial use and in an "at work" capacity (whether for a company, partnership, public sector body, charity etc.) then these restrictions also bind your employer (or equivalent) who is responsible for your use of howtospendit.com.

3. Privacy Policy and Registration

All information received by you from your use of howtospendit.com will be used by FT in accordance with our Privacy Policy.

If you choose to register with howtospendit.com, on registration, you must provide FT with accurate, complete registration information and it is your responsibility to update and maintain changes to that information on the applicable howtospendit.com registration pages. FT is entitled to rely on any information you provide to us.

Each registration is for a single user only. On registration, you will choose a user name and password (which we call an "ID"). FT does not permit any other person sharing your ID or access through a single ID being made available to multiple users on a network or within an organization. FT may cancel or suspend your access to howtospendit.com if you do this without further obligation to you.

You are responsible for all use of howtospendit.com made by you or anyone else using your ID and for preventing unauthorised use of your ID. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use or sharing of your ID, you must notify FT immediately by e-mailing us at www.HowToSpendIt.com. We recommend that you do not select an obvious password (such as your name) and that you change it regularly.

If you provide FT with an email address that will result in any messages FT may send you being sent to you via a network or device operated or owned by a third party (e.g. your employer or college) then you promise that you are entitled to receive those messages. You also agree that FT may refrain from sending messages to you without notifying you.

4. Third Party Sites and Services

howtospendit.com may contain links to other Internet websites or online and mobile services provided by independent third parties, including websites of our advertisers and sponsors (which we call "Third Party Sites"). Third Party Sites may be co-branded with FT and so include FT's trade marks.

Whilst we will highlight products and services sold by third parties that we think may be of interest to our users, it is your decision whether you purchase any third party products or services and you should read Section 5 below carefully. Our Privacy Policy does not apply to Third Party Sites.

howtospendit.com contains advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on howtospendit.com complies with international and national law. FT will not be responsible for any error or inaccuracy in advertising or sponsorship material.

Copyright in any software that is made available for download from howtospendit.com belongs to FT or its suppliers. Your use of the software is governed by the terms of any licence agreement that may accompany or be included with the software. FT is not responsible for any technical or other issues that may arise if you download third party software. Do not install or use any software unless you agree to such licence agreement.

5. LIMITATION OF LIABILITY

A summary of what this section means: this section is important and you should read it carefully. It makes clear that FT does not accept any liability to you for your use of the howtospendit.com website or the HTSI Content or in respect of any third party products or services that we refer to on howtospendit.com. If you buy or use any third party products or services then that is your responsibility and not ours. Where we refer to "Third Party Sites" we mean websites, online or mobile services provided by third parties, including websites of advertisers and sponsors that may appear on howtospendit.com. Where we refer to “Third Party Products” we mean products or services provided by third parties. Although howtospendit.com may provide Third Party Sites or Third Party Products with coverage that you might perceive as portraying them in a positive light or as desirable, we make no recommendation that any such Third Party Site or Third Party Product is appropriate for any individual user or that it will meet your expectations or requirements. Further details on what this means are set out below.

The HTSI Content (including any information we publish regarding Third Party Products) is only for your general information and entertainment purposes and is not intended to address your particular requirements. In particular, the HTSI Content does not constitute any form of advice, recommendation, representation, sponsorship, endorsement or arrangement by FT and is not intended to be and should not be relied upon by you in making (or refraining from making) any specific purchase, sale, investment or other decisions. THIS MEANS THAT FT DOES NOT MAKE ANY PROMISES IN RESPECT OF HOWTOSPENDIT.COM OR THE SERVICES AND FUNCTIONS AVAILABLE ON OR THROUGH HOWTOSPENDIT.COM OR OF THE QUALITY, COMPLETENESS OR ACCURACY OF THE INFORMATION PUBLISHED ON OR LINKED TO FROM HOWTOSPENDIT.COM. The above disclaimers apply equally to your use of howtospendit.com and all HTSI Content. Without limiting the above, FT is not liable for matters beyond its reasonable control. FT does not control third party communications networks (including your Internet Service Provider), the Internet, acts of God or the acts of third parties.

THE LIMITATIONS OF LIABILITY PROVIDED IN THIS SECTION 5 APPLY FOR THE BENEFIT OF FT, ITS AFFILIATES AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS.

Notwithstanding anything else contained in the provisions of this Section 5, FT's liability will not be limited in the case of death or personal injury directly caused by FT's negligence in those countries where it is unlawful for FT to seek to exclude such liability.

6. Choice of Law and Jurisdiction

These terms and conditions shall be governed by, and construed in accordance with, English law.

To the extent possible in the applicable jurisdiction, the parties irrevocably agree that the courts of England shall (subject to the paragraph below) have non-exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions.

For the exclusive benefit of FT and to the extent possible in the applicable jurisdiction, FT shall retain the right to bring or enforce proceedings as to the substance of the matter in the courts of the country of your residence or, where these terms and conditions are entered into in the course of your trade, business or profession, the country of the place of business in which you agreed to these terms and conditions or (if different) the country of your principal place of business.

7. General

We do not charge users for access to howtospendit.com, but you are responsible for paying any internet connection or other telecommunications charges that you may incur by accessing howtospendit.com.

You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions. We may assign, sub-license or otherwise transfer any of our rights to any third party.

If any provision of these terms and conditions is found to be invalid by any court or regulatory authority having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.
